Who owns Indian Head Rock- Kentucky vs Ohio

Description:

A fight is brewing between Kentucky and Ohio over a boulder that was pulled from the Ohio River. Indian Head Rock was a well know boulder that was used as a navigational marker when the river was a major transportation thruway. Since building the Dam in the 1920’s, the rock has not been seen until now. Steve Shaffer found it and brought it to Portsmouth, Ohio where it now resides in the Portsmouth Municipal Garage. The rock has many carving by residence dating back to 1856. 

Kentucky is claiming that it has been stolen and demands the returned. Ohio found it and wants to keep it. So for now, the rocks history is in the hands of the courts.

This is a question of legalities. The Indian Head Rock was located in that part of the Ohio River which belongs to the state of Kentucky, per a Supreme Court decision. The rock was a registered archaeological site within Kentucky and, as such, was protected by law with legal and civil penalties specified for its disturbance. Transportation of archaeological materials (such as Indian Head Rock) across state lines in violation of a state antiquity law, which Kentucky has, also is a federal offense under the Archaeological Resources Protection Act (ARPA). The rock also apparently was moved without obtaining a permit from the U.S. Army Corps of Engineers, which has jurisdiction over all waterways in the U.S. The movers of the rock now have been indicted by a grand jury in Kentucky and, unfortunately, are now finding out that the state of Kentucky takes protection of its archaeological sites very seriously.

How is the KY side of the argymenyt weak? KY owns the Ohio River where the rock was located, and documented. Just because KY chose not to pull it out doesnt make it right for OHIO GOV'T to allow the rock to be stolen!!!! Ohio thieves!

To stop all hassel, the Rock should be put back then no-one owns it!

The Indian Head Rock, shall be use as a moniment, if anyone would like to view the Indian Head Rock, they will be charged $10 to view it, the money that has been raised, will go to, raising awearness, for the third world!

I saw this story on Sunday Morning recently. I have to say, the Kentucky side of the argument is so weak as to be laughable. KY--a bunch of looters in this case. Why not offer to buy the rock? I guess it's easier to have the government steal it for you, right, looter KY?

Why do you call Ky. a bunch of looters when they own the Ohio River?
